 abstract={Company trade unions play an important law-making role in the collective redundancy procedure as entities authorized to conclude agreements on collective redundancies. However, the author of this article argues that the jurisprudence of the Polish Supreme Court has unlawfully limited the law-making role of trade unions in the situation when collective redundancies take the form of voluntary departure programs. The consequence of emphasizing the law-making role of trade unions in the process of collective redundancies is the limitation of their role at the stage of applying the law, which is particularly reflected in the release of employers from the obligation to consult the intention to terminate employment contract by notice. Therefore, trade unions do not have the possibility to subsequently control the application of the collective agreement they have concluded. Attempts to expand the scope of activity of company trade unions in the scope of controlling the application of the law in collective redundancies encounter significant obstacles, especially under the provisions on the protection of personal data.},
