 abstract={The model of the carbon dioxide emissions permission is a legal measure of climate policy. The aim of this model is a reduction of emissions of these greenhouse gases into the air. This model includes two systems of regulation that concern: permits excluding the general prohibition on carbon dioxide emissions into the air and scheme for greenhouse gas emission allowance trading. Firstly, the carbon dioxide emissions permission excludes the general prohibition on emitting this greenhouse gas. The subjects of this prohibition are entities who are using installations emitting these gases. This prohibition applies to the emission of carbon dioxide. There are limited number of permissions, which are excluding this prohibition. Secondly, the carbon dioxide emissions permission can be traded in the EU Emissions Trading System (EU ETS). The basis of this system is a limited number of permissions in relation to the needs of entities who are using emitting installations, as well as the freedom to trade in these permissions. The carbon dioxide emissions permission is a specific public subjective right, special feature of which is the admissibility of being transferred by civil law activities. The subject of these rights could be variable. An emission permission includes a claim against the public authorities to not interfere with the emission of a certain amount of carbon dioxide into the air.},
