The aforementioned threat materialises both at the stage of the creation of the LLM and at the stage of the subsequent functioning of such model. On the subject of the use of others’ works, the disputes in the legal doctrine are mainly related to the scope of fair use of works within the framework of text and data mining, to the so-called phenomenon of memorisation of training data by LLM and to the phenomenon of so-called regurgitation, i.e. the “return” of fragments of protected training data by LLM in generated content. The disputes indicated were fuelled by the procedure of the latest AI legislation, i.e. primarily the Artificial Intelligence Act, of which subsequent versions appeared in Q1 2024 – and the latest version of which was adopted on 13th of June 2024 – including references to provisions on text and data mining under the Digital Single Market Copyright Directive.
