He strives to show what in his opinion was especially influential in the creation of this very doctrine, inter alias the idea of law of Walter Benjamin, who acknowledged the difference between “divine” and “mythical” violence. The author aims to show the connections between the doctrine of Carl Schmitt and Giorgio Agamben. In the article it is stated that Agambenian state of exception has significantly paradoxical nature, for it may be acknowledged as a maximization of efficiency of norms by suspension of them. Another paradoxical factor of Agambenian state of exception is that, even though it is called “exceptional,” it is practically rather “normal” than “exceptional”, because without it, it is impossible to execute any norm.
