 abstract={The right to defence is one of the essential elements of the right to a fair trial. The article concerns the right to defence including the right to use the assistance of a defence counsel in the International Criminal Court proceedings considering certain problematic aspects resulting from the interpretation of the Rome Statute which is the basis for the Court operations. The content describes appointment of a defence counsel for the self-defence and ex officio defence. The participation of the defence counsel at each stage of the Court proceedings was also briefly described. The issue of confidentiality in contacts between the defence counsel and their client was also analysed. There is no doubt that the right to defence in the formal aspect can only be exercised if full confidentiality is guaranteed. In addition, the qualifications required from a defence counsel appearing before the International Criminal Court were indicated along with how they are listed as one of the permanent defence counsels and the specific role of a defence counsel and the problems they must face while performing their function in the International Criminal Court proceedings were specified.},
