Unclear legal classification of Cookies results in strong discrepancies in interpretation and non-compilance with legal obligations in that regard. This publication is primarily devoted to determining in what circumstances and to what extent cookies may constitute personal data by discussing the rationale behind them. This issue will be presented in the context of the case law of the Court of Justice of the European Union, guidelines of European Data Protection Board and Art. 29 Working Party and considerations of Polish judicary, including proceedings before Polish Supervisory Authority. The main purpose of the publication is to present a practical summary of the considerations of the Court of Justice of the European Union, guidelines of the European Data Protection Board and Art. 29 Working Party, considerations of Polish Administrative Court in Warsaw and Polish Supervisory Authority. Cookies will also be analyzed in terms of the legal basis for the processing of personal data contained therein.
