 abstract={The purpose of this article is to present the issue of expert witness offences related to the issue of a false opinion in theory and practice. The article has been prepared on the basis of a search of forensic literature and on the basis of own research results concerning the offence under Articles 233, paragraphs 4 and 4a of the Penal Code. The article is divided into two parts. The first part presents the theoretical aspects of the crime related to the issuance of a false opinion by an expert. The second part is a presentation of the results of own research summarised with conclusions from the research findings. The results of the conducted research indicate that the condition of justice related to false opinion is not bad, however, the procedural authorities face a twofold problem related to this issue. Firstly, the construction of the intentionality of the offence under Article 233(4) of the Penal Code implies limited possibilities of attributing the offence of false opinion to an expert, and secondly, the trial authorities often make a wrong subsumption of the facts as to the prerequisites of an expert’s liability for giving a false opinion.},
