 abstract={The aim of the following paper is to characterise the fundamental difference between the regulation of art. art. 6(2) of Statute on powiat self-government of 5.06.1998 and certain regulations contained in the Statute on communal economy of 20.12.1996, in the Statute on district self-government of 8.03.1990 and in the Statute on voivodeship self-government of 5.06.1998. The mentioned regulations concern the subject of public economic activity that surpasses the sphere of public utility of powiat and other self-government entities. The further part of the following paper is dedicated to the subject of forming and entering to partnerships and capital companies of commercial law by local government units. The whole paper as such is aimed to descript the abiding law. The author also aims to point out the resolutions, that in his opinion require correction.},
