  The constitutional right to a fair trial, which is regulated in art. 45 paragraph 1 of the Constitution of the Republic of Poland, plays an extremely important role in a democraticstate of law. The aim of this study is to present and examine the limitations of the constitutional right to a fair trial. The article focuses on the definition of the right to a fair trial, the admissibility of limitations, the term of “case,” authority, the principles of procedural fairness and procedural formalism as well as economic barriers. The right to a fair trial is the basis and guarantee of all other rights. However, it is not an absolute right and some limitations are allowed. The key is to meet the conditions set out in art. 31 paragraph 3 and art. 77 paragraph 2 of the Constitution of the Republic of Poland.;
  
  
  
  Konstytucyjne prawo do sądu, uregulowane w art. 45 ust. 1 Konstytucji Rzeczypospolitej Polskiej, odgrywa niezwykle istotną rolę w demokratycznym państwie prawa. Celem niniejszego opracowania jest przedstawienie i zbadanie ograniczeń konstytucyjnego prawa dosądu. W tekście została poruszona problematyka definicji prawa do sądu, dopuszczalności ograniczeń, pojęcia sprawy, organu, zasady sprawiedliwości proceduralnej i formalizmu procesowego oraz barier ekonomicznych. Prawo do sądu jest podstawą i gwarancją wszystkich innych praw. Nie jest jednak prawem bezwzględnym i dopuszczalne są jego ograniczenia. Kluczowe jest w tym względzie spełnienie wskazanych w art. 31 ust. 3 Konstytucji RP przesłanek oraz art. 77 ust. 2 Konstytucji RP.
