The article addresses the question of legal nature of recruitment committees which conduct recruitment procedures for school, kindergarten or other public educational institution, respectively. The starting point for the research analysis explaining the nature of this entity is the constitutional regulations that are closely linked to the activity of the committee in question and which indicate the public character of the institution. In the following, additional arguments in favor of this feature of the commission were presented, at the same time outlining the specifics of the recruitment procedure and, moreover, its relation to the provisions of the Code of Administrative Procedure. Subsequently, based on the composition of the committee and on the director of the appropriate educational institution, the nature of the recruitment committee was different to the public administration body. In the final section, referring to previous considerations and the acquis of administrative law, a precise definition was made – reflecting the nature of the recruitment commission.
