Wydział Prawa, Administracji i Ekonomii Uniwersytetu Wrocławskiego N2 - The subject of the article is the right to education. It is a universal right and its execution has been granted by international, European and national legal acts. It is characterized by specific features. It is treated both as a right and as a duty (compulsory education) in relation to a specific person. Its implementation takes place within units of the educational system specified in the Act. One of them is a public primary special school organised in a healthcare entity. Its aim is to meet educational needs of children and youth residing there. In this case, the right to education is implemented in special conditions, which are related to the disease of the patient. Therefore, it is necessary to adjust parallel exercise of the right to education and the right to health care. As a consequence, educational process in those entities may be modified. These modifications will be analysed in this work. Moreover, it will attempt to determine the consequences of the conflict arising from parallel exercise of the right to education and the right to health care.
